1. Introduction
These Terms of Service ("Terms") govern access to and use of BuildSpace's websites, APIs, hosting services, deployment tools, marketplace, analytics, billing integrations, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
2. Nature of the Services
BuildSpace provides infrastructure and tooling that enables users ("Builders") to build, deploy, host, monitor, and monetize applications.
BuildSpace:
- Does not create or operate Builder applications
- Does not pre-screen or monitor applications
- Is not the publisher of Builder content
- Is not responsible for Builder business operations
You are solely responsible for your applications and all associated content and data.
3. Accounts
You must:
- Provide accurate information
- Maintain credential security
- Be responsible for all activity under your account
We may suspend or terminate accounts at our discretion.
4. Builder Responsibility
You are solely responsible for:
- Code you develop
- Data you collect or process
- Legal compliance (privacy, consumer protection, export laws)
- Security of your applications
- Providing terms and privacy policies to your end users
BuildSpace is not responsible for:
- Data loss
- Application-level security breaches
- Disputes between you and your users
- Regulatory violations by your application
5. Acceptable Use
You must comply with the Acceptable Use and Fair Use Policies.
We may suspend, throttle, or terminate services for violations.
6. Fees and Payments
Paid features require payment.
- Fees are posted publicly
- Fees are non-refundable unless required by law
- Payment processing may be handled by third parties
BuildSpace is not responsible for disputes between Builders and their customers.
7. Marketplace
If you list an application:
- You are the merchant of record unless explicitly stated
- You are responsible for compliance and support
- You must provide your own legal terms
BuildSpace may remove listings at its sole discretion.
8. Intellectual Property
Builders retain ownership of their applications.
BuildSpace retains ownership of its platform, APIs, documentation, and branding.
You grant BuildSpace a limited license to host and process your content solely to provide the Services.
9. Indemnification
You agree to indemnify and hold harmless BuildSpace from claims arising from:
- Your applications
- Your content
- Your legal violations
- Your users
10. Limitation of Liability
To the maximum extent permitted by law, BuildSpace shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits
- Data loss
- Business interruption
Total liability is capped at the greater of:
- Fees paid in the prior 12 months
- $100
11. Termination
We may suspend or terminate Services at any time.
Indemnity and liability limitations survive termination.
12. Governing Law
Governed by Delaware law.
Disputes resolved by binding arbitration with class action waiver.
